All Hammond Lake Estates residents are bound to deed restrictions whether you are a member of the association or not. You entered into legally binding terms when you purchased your property. The association (or any owner) may legally enforce a violation of these restrictions. The information below is only a summary of common issues. The full copy can be downloaded here.

 

Deed Restrictions

Boat Motors: The use of a motor of any type on a boat is absolutely prohibited. This deed restriction was challenged in district court May 2006 and upheld. This includes gas & electric.

Structures: No structures shall be constructed within 40 feet of Hammond Lake (high water line)

Out Buildings: Permanent structures without building permits are prohibited. Contact the association if you have questions about external structures. Note that any type of shed on lakefront property needs a permit from either township.

Fences: 

a) Lake Front Property: Absolutely no fencing within 40 feet of the lake. Otherwise, only SIDE lot fences are permitted.

b) Non Lake Front Property: Fences are permitted below 4 feet in height. Woven wire, painted wood, rail, or colonial style construction are permitted. Solid fences are prohibited. Township permits may be required.

Lake Access: No lot shall be used to provide or permit access to people other than the owners, immediate family, and invited guests.

Grounds Maintenance: Owners shall keep the weeds cut and their property in neat appearance at all times. 

 

Bloomfield Township Ordinances

Waste Pickup: Set out waste containers no earlier than noon of the day preceding waste pickup. Restore containers within 12 hours of pickup. Solid waste, recyclables and yard waste must be set out in separate containers not exceeding 60 pounds or 32 gallons. Tree branches up to 2 inches in diameter and 4 feet long should be bundled. 

Noise, Construction and Commercial Yard Maintenance: In general, a 75-decibel level limit is measured 25 feet from the noise source between 7:00 am and 6:00 pm Monday-Saturday. Work is not permitted on Sundays or national holidays. 

Resident Mowing: No limitations on days or hours are defined. Courtesy to your neighbors and circumstances are the guidelines. The maximum allowable height of weeds or grasses is 8 inches. 

Open Storage: Open storage of licensed automobiles (driveway), boats (lakeyard), patio furniture and neat wood piles are permitted. Recreational, commercial or unlicensed vehicles and materials (tools, equipment, trash, etc.) may not be in public view. Banned items may be stored temporarily for packing or repairs. The township should be notified in advance. 

Shorelines: Fertilizer shall not be applied within 25 feet of a shoreline. Filling, draining, excavating, planting, plant removal or construction are not permitted. Check with the township before any work is to be done in the 25-foot setback. 

Fertilizer: Fertilizers with slow release nitrogen and without phosphorous should be used at a frequency of not less than 6 weeks. A commercial applicator must have a township sticker on the driver side rear bumper. Fertilizer should be watered in within 24 hours to minimize runoff. 

Fences: A permit is required for any fence. Fences over 4 feet high must be approved by the zoning board. 

Garage Sales: No permit is required and courtesy to your neighbors is the guideline. Sales should not exceed 2 or 3 per year and may only include your materials. 

Fireworks: Michigan legal fireworks may be discharged by a resident 18 years or older on his / her own property the day before, day of and day after a national holiday. Discharge is not allowed between midnight and 8:00 am, except for New Year’s Day when 1:00 am and 8:00 am is the limit. 

Burning: Burning is prohibited except for persons aged 18 years or older may burn dry firewood in a container designed for the purpose or customary cooking food in normal barbecuing devices. 

 

West Bloomfield Township Ordinances

(Call: 248-451-4818) 

Waste Pickup: Set out waste containers no earlier than 6:00 pm on the day preceding waste pickup. Restore containers by 7:00 pm the day of pickup. Yard clippings (twigs, brush and branches) not exceeding 2 inches in diameter must be tied in bundles of not more than 4 feet long and 18 inches in diameter. An owner may suspend pickup service for up to 3 months twice per year.

Noise, Construction and Yard Maintenance: In general, noise measured at the lot line may not exceed 85 decibels between 7:00 am and 10:00 pm. 75 decibels is the limit from 10:00 pm to 7:00 am. Other limitations include, but are not limited to: Construction 7:00 am to 7:00 pm, Monday-Friday and 10:00 am to 7:00 pm, Saturday and Sunday; Lawn and Tree services 8:00 am to 7:00 pm, Monday-Friday and 9:00 am to 7:00 pm, Saturday, Sunday and government holidays; Home Occupant lawn, tree and landscape activities 8:00 am to 9:00 pm, Monday-Friday, and 9:00 am to 9:00 pm, Saturday, Sunday, and government holidays.

Open Storage: In general, open visual storage is not permitted. Lakeside owners may store up to 2 of their boats on their property. Non-lakeside owners may store up to 2 boats on their property from March 1 to October 31 and off-property beyond these dates.

Lakeshore: A permit is required for any work performed within 25 feet of the shoreline except for mowing and spot weed killing.

Fertilizer: Non-phosphorus fertilizer may be applied up to 5 times between May 1 and November 15 (providing there is no frost on the ground) and no less than 6 weeks between applications. Any fertilizer applied to walks, drives or other non-landscaped areas must be removed within 2 hours. An approved applicator must have a licensed sticker on the driver side front bumper of each vehicle.

Burning: Burning of any type is not permitted except in a covered grill or hibachi. An outdoor fireplace may be used with a minimum 6-foot to 8-foot chimney.

Garage Sales: An owner may apply for up to 2 permits per 12 months. A sale may last up to 72 hours and operate between 9:00 am and 1 hour after sunset. No traffic obstruction is allowed.

Fireworks: Michigan legal fireworks may be ignited by a person aged 18 or older on his / her property on the day before, the day of and the day after
national holidays from 8:00 am until midnight. On New Year’s Day the curfew is 1:00 am.
